Acceptance

By accessing this site, or purchasing a licence for our software, you agree to these terms. If you don’t agree, please don’t use the site or the software.

Use of the site

You agree to use the site only for lawful purposes and not to:

• Attempt to gain unauthorised access to the site or any related systems.
• Use any automated means to harvest data or submit forms.
• Post or transmit any unlawful, threatening, defamatory, or otherwise objectionable material.

What we sell

We sell an annual (12 month) licence for phone monitoring and GPS tracking software for smartphones, along with setup help and ongoing support from our team, which includes licensed private investigators. The licence:

• Runs for 12 months from activation and can be renewed.
• Is issued to you personally and is not transferable to another customer or another device beyond what your plan allows.

Lawful use only: the condition of every sale

This is a condition of every sale, not just a recommendation. Our software may only be used to monitor a device where one of the following applies:

• You own the device or are legally responsible for it, such as a smartphone belonging to your own minor child.
• The device is owned by your company, a written workplace surveillance policy is in place, and any employees using the device have been notified in accordance with the Workplace Surveillance Act 2005 (NSW) or the equivalent law in your jurisdiction.
• You have the informed consent of the adult who uses the device.

By purchasing a licence, you warrant that you have the legal right to monitor the device you intend to use the software on, and that your use will comply with the Surveillance Devices Act 2007 (NSW) and equivalent laws in other Australian states and territories, the Telecommunications (Interception and Access) Act 1979 (Cth), and the Privacy Act 1988 (Cth). You are responsible for your own compliance with these laws, including obtaining any consents or notices they require.

We may refuse to accept an order, or cancel an existing licence, where we reasonably believe the intended use of the software is unlawful or breaches this warranty.

Payments and refunds

We accept payment by card or bank deposit. We do not store full card numbers.

• Before activation: if the software cannot be installed on a supported device after you have worked with our support team to try to resolve the issue, you can request a full refund within 14 days of purchase.
• After activation: once the software has been activated and is reporting data, the licence is not refundable.

Your monitoring account and data

Data captured through the software from a monitored device belongs to you. We hold it only to provide the service, retain it for the length of your licence plus 30 days unless you ask us to delete it sooner, and our support team accesses it only with your permission to help with setup or a support issue. Intellectual property

All content on this site, and the software itself, is owned by Phone Tracker unless otherwise indicated. You may view and download website content for personal, non-commercial use only. Your software licence gives you the right to use the software during your licence period; it does not transfer ownership of the software to you.

No warranty

The site and the software are provided “as is”. To the extent permitted by the Australian Consumer Law, we make no other warranties about the site or the software, including that the software will be free of faults or will meet your specific requirements. Nothing in these terms excludes, restricts, or modifies any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law.

Limitation of liability

To the maximum extent permitted by law, Phone Tracker is not liable for any indirect, incidental, or consequential loss arising from use of this site or the software, including any loss arising from your use of the software in a way that breaches the lawful use condition above.

Governing law

These terms are governed by the laws of New South Wales and the Commonwealth of Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.

We may update these terms from time to time. The “Last updated” date above reflects the most recent revision.
